Tailgating

Tickets for Following Too Closely, commonly referred to as “tailgating,” are among the most serious in New Jersey.  If you are charged with Tailgating it is in your best interest to contact an experienced New Jersey traffic attorney.

New Jersey statute 39:4-89 provides:

Tailgating, Following; space between trucks The driver of a vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard to the speed of the preceding vehicle and the traffic upon, and condition of, the highway.

The driver of a motor truck when traveling upon a highway, outside of a business or residence district, shall not follow another motor truck within one hundred feet, but this shall not be construed to prevent one motor truck overtaking and passing another.

Drivers convicted under this law face 5 points, fines, increased insurance premiums and even jail.  The Judge also has the discretion to suspend your license.   As a result of these serious penalties, if you have received a Tailgating ticket you should contact an attorney immediately.  An experienced New Jersey Tailgating lawyer will have the skill to evaluate the evidence against you and recommend the most prudent course of action.  This law firm has represented thousands of clients charged with traffic offenses throughout New Jersey.  We are available for consultation at a time of your choosing.
